1. About These Terms
These terms govern your use of vida-visual.com and the client pages we host — galleries, questionnaires, contracts and invoices — and the process of requesting and booking work from Vida Visual Media, a photography and video studio in Riverside, California, owned and operated by Francisco Sarmiento.
These terms do not replace your contract. Every booking is governed by a separate Photography Services Agreement that you sign. Where anything here conflicts with that signed agreement, the signed agreement controls. The summary in Section 4 is here so you know what to expect before you sign — not to bind you to something you have not read.
2. Using This Site
You are welcome to browse, read, share links and submit an inquiry. You may not scrape the site, republish our photographs or written content elsewhere, attempt to reach parts of the site you have not been given access to, submit false information through our forms, or use anything from this site to train a machine learning model without our written permission.
Prices, packages and availability shown on this site are current at the time of publication and may change. Nothing on this site is a binding offer — a booking exists only once a contract is signed and the retainer is received.
3. Inquiries, Quotes and Booking
Submitting a form does not reserve your date. Dates are held only when both of the following are complete:
- You have signed the Photography Services Agreement, and
- The retainer has been paid
Until then the date remains available to anyone else. Quotes are valid for 14 days unless stated otherwise on the quote itself.
4. What Your Agreement Will Say
The terms below are standard in every Vida Visual services agreement. They are summarised here in plain language; the signed agreement is the operative text.
- Retainer. The retainer is due on signing and is non-refundable. It compensates us for committing the date and turning away other work for it. It is credited against your total fee.
- Balance. The remaining balance is due on the date stated in your agreement, which is before the event unless we have agreed otherwise in writing.
- Cancelling or moving your date. Give us written notice at least 7 days before the scheduled date. Without that notice, cancelling or rescheduling does not release you from the payment obligations in your agreement. We will always try to accommodate a new date if we are free.
- Travel. Reasonable travel expenses are yours where the work takes place outside the base location named in your agreement.
- Style and creative judgment. You have seen our portfolio and are hiring us for that way of working. We will listen to your requests and shot lists, and final decisions about aesthetics and artistic quality are ours. Disagreement with our creative judgment is not a basis for terminating the agreement or requesting a refund.
- Copyright. We retain copyright in all photographs and video we create. You receive a personal licence to use, print and share your images — including on social media — for your own non-commercial purposes. Commercial or vendor use requires our written permission.
- Our use of your images. The agreement grants us the right to use images from your event in our portfolio, on this site and on social media. If you would rather we did not, tell us in writing — see our Privacy Policy, Section 8.
- Permissions at your venue. You are responsible for securing whatever permissions your venue or location requires for us to work and to deliver the images.
- Limitation of liability. If something goes irrecoverably wrong on our side, our total liability is limited to refunding the retainer and all fees you have paid. We carry professional equipment, backups and redundancy specifically so this does not happen.
- Force majeure. Neither of us is in breach for a delay caused by illness, fire, natural disaster, pandemic, or anything else genuinely outside our control. Performance is extended for the duration.
5. Payments
Card payments are processed by Stripe; we never see or store your full card number. We also accept Zelle and cash, recorded manually against your invoice. Invoices are due on the date shown on them, and automated reminders are sent before and after that date.
Refunds, where they apply, follow your signed agreement — the retainer is not refundable in any case. A card dispute filed instead of contacting us costs both of us time; please write to us first and we will sort it out.
6. Client Galleries and Access Links
Galleries are delivered through a password or an emailed access link. That access is for you and the people you choose to share it with; you are responsible for who you pass it to. Galleries remain online for the period stated in your agreement — download and back up your images. We keep archive copies as a courtesy, not as a guarantee.
7. Communications
By inquiring or booking, you agree that we may contact you by email and phone about your inquiry, your booking and your delivery. Studio news and marketing emails are separate and carry an unsubscribe link in every message. How we handle your information is described in our Privacy Policy.
8. Third-Party Services
This site links to and relies on services we do not operate — Stripe, HubSpot, Google, Meta, Microsoft, Vercel and others. Their terms and privacy practices are their own, and we are not responsible for content on sites we link to.
9. Disclaimer
This site is provided as it is. We work to keep it accurate and available, but we do not guarantee it will be uninterrupted or error-free, and we are not liable for indirect or consequential loss arising from your use of it. Nothing in these terms limits any liability that cannot lawfully be limited.
10. Disputes and Governing Law
These terms and any signed services agreement are governed by the laws of the State of California, and any dispute belongs in the state or federal courts serving Riverside County, California.
Before that: write to info@vida-visual.com and give us 30 days to make it right. Almost everything gets resolved in a phone call.
11. Changes to These Terms
We may update these terms; the date at the top shows when they last changed. Changes apply from the day they are posted and do not alter the terms of an agreement you have already signed.
